Despite requesting to view our chosen plot we were denied the opportunity before exchange of contracts in December 2021. Our plot was at the foundations stage and there was nothing to see we were told. We were only allowed access to our plot a couple of weeks after exchange of contracts. Homes at the rear of our plot had already been partially constructed but we were not made aware of this. When allowed on site for the first time we were shocked to see homes being built at the rear overlooking our plot were on much higher ground which meant we would not need just fencing on our boundary as previously advised. We were then advised that a boundary retaining wall would be needed with fencing above that and a trellis was suggested on top of this to help with the lack of privacy from these homes overlooking ours. Not something we were previously made aware of. We felt hemmed in and did not like the thought of living with the sight of a boundary height of potentially over twelve foot and with a lack of privacy. The only advice from our solicitor, recommended by the developers, and knowing the full details, was that we would lose our deposit of we didn't go ahead with the purchase. Although having a duty of care to act in our best interests and us having a good case against the developer our solicitor did nothing to assist us. We advised DW Homes that we had decided not to go ahead with the purchase. An agreement was made to rescind the contract on both sides with our deposit being refunded in full. It took 35 days from DW Homes making the decision to rescind the contract to us receiving our deposit back in full. Why such a delay when they insist exchange of contracts must be within 28 days of paying the initial holding deposit ? Note to any potential buyers. If you value your privacy, always view the plot. Don't take a chance on the ground in neighbouring gardens being on the same level as yours. Definitely DO NOT use a solicitor recommended by the developers. With hindsight it was a big mistake for us to do so. Request details of the exact cost of upgrades before exchange of contracts. Luna in the sales office was a great help to us in chasing our refund payment, without her help we would probably still be waiting to receive it. We have decided not to buy on this development.
